The company OneShuttle which headquarters are located at 15 Rues des travaux du Roy, 78660 Prunay en Yvelines, FRANCE, is a French Company
OneShuttle is registered at the Versailles Trade Office under the SIRET number 38252200100025. Its commercial name is OneShuttle and its main business is the organization of sales to its Clients by independent suppliers.
The company OneShuttle, as a carrier, has a main business of private transfer of travelers between pre-determined destinations indicated by the Client.
Subject Matter: the services rendered by OneShuttle are reserved for individuals, as well as legal entities having a legal personality, on behalf of their employees or representatives (hereinafter “the Client(s)”). OneShuttle does not accept reservations from unaccompanied minors.
These standard terms (hereinafter “the Contract”) define the terms and conditions offered by OneShuttle. They are available on the web site www.OneShuttle.com.
1 - DEFINITIONS
The following definitions are applicable in these Terms and Conditions of Trade.
a) "Website": means the website edited by OneShuttle and reachable using the address: http://www.1Shuttle.com
b) "Client": means anyone who pays OneShuttle to get a transportation service. The Client must be over 18 years of age. Any person willing to become a Client should register by phone, mail or on the Website to receive the status of Client and be able to send Enquiries and Booking Requests to OneShuttle.
c) "Booking Request": means any request of carriage service sent by the Client to OneShuttle.
2 - ENTIRE AGREEMENT
These Terms and Conditions of Trade constitute the entire agreement between the Client and OneShuttle with respect to the subject matter hereof and will supersede and replace any other understandings and agreements, in whatever form, regarding the subject matter. Nothing in this clause shall exclude or restrict the liability of either the Client or OneShuttle arising out of fraud or fraudulent misrepresentation.
These Terms and Conditions of Trade are systematically shown to and signed by anyone wishing to become a Client.
THE CLIENT EXPRESSLY ACKNOWLEDGE THAT HE HAS READ THIS AGREEMENT AND UNDERSTAND THE RIGHTS, OBLIGATIONS, TERMS AND CONDITIONS SET FORTH HEREIN. BY USING OUR SERVICE OR OUR WEBSITE, THE CLIENT EXPRESSLY CONSENT TO BE BOUND BY THESE TERMS AND CONDITIONS OF TRADE AND GRANT TO OneShuttle THE RIGHTS SET FORTH HEREIN.
The failure to exercise, or delay in exercising, a right, power or remedy provided by these Terms and Conditions of Trade or by law shall not constitute a waiver of that right, power or remedy. If OneShuttle waives a breach of any provision of these Terms and Conditions of Trade, this shall not operate as a waiver of a subsequent breach of that provision, or as a waiver of a breach of any other provision.
3 - BOOKING PROCESS
OneShuttle can only be used following a booking request. OneShuttle is bound by the French transport law of 11/2/1986 article 5 which states that OneShuttle must be in possession of a clear manifest stating clearly the names & destinations of OneShuttle’s clients.
A reservation request should not be considered as being accepted or confirmed until the client has received a confirmation email or SMS from OneShuttle.
The prices indicated on the Website are in Euros and include all taxes unless otherwise stated.
Any order or booking will be confirmed only after payment by credit card using the secured Paypal payment system provided by OneShuttle on its website.
To order a transfer or to send an enquiry about the carriage services offered by OneShuttle, the Client should use one of the following options:

4 - BOOKING ENQUIRY
To order a carriage service offered by OneShuttle, the Client should use one of the options described in article 3.
(a) Rules regarding Booking Requests
When the Client places a Booking Request on the website, OneShuttle shall email the Client an acknowledgement of the intended order.
(b) Booking Confirmation by OneShuttle
Any booking request will be confirmed in a timely manner by OneShuttle by email. This booking confirmation will include at least the type of carriage service, the price including and excluding VAT and the conditions of cancellation.
5 - PAYMENT PROCESS
(a) Price of the carriage service:
The carriage service will be billed to the Client on the basis of the firm prices indicated in the order confirmation by OneShuttle (prices are in euros and inclusive of VAT, where applicable).
(b) How to pay for the carriage service
The Client will directly pay OneShuttle for the carriage service on the website www.OneShuttle.com by credit card through the payment platform.
(c) Deposit for booking
In certain cases, OneShuttle will require the Client to pay a non-refundable booking fee in advance.
(d) Payment default
Any payment default by a Client allows OneShuttle to cancel all pending orders or deliveries, without prior notice or any possible claim by the Client.
6 – CONDITIONS OF THE CARRIAGE SERVICE
(a) On board safety
All Clients are required to respect local laws & regulations when onboard.
In accordance with French traffic law, all Clients must therefore wear seatbelts at all times whilst aboard OneShuttle’s vehicle.
OneShuttle’s driver reserves the right to refuse any Clients that may be deemed unfit or unsuitable to travel.
(b) Child Seats
When booking a Carriage Service, OneShuttle might provide baby seats for free (upon request and subject to availability)
7 - LIABILITIES
(a) Suitcases and personal items: OneShuttle will take no responsibility for Client’s suitcases or any personal item. In particular, in case of loss, theft or damages on these suitcases and personal items, the Client will not get any compensation and will not be able to sue OneShuttle as the Client is fully responsible for the content of his luggage. OneShuttle cannot be held liable for the loss, theft or damage, at the time of loading, transfer or unloading, of the Client’s luggage.
(b) The vehicles made available to the Client are conform to the technical standards required by French regulations in force.
(c) OneShuttle’s drivers are required to comply with the provisions stipulated by the French Highway Code [le Code de la Route], namely, the rules governing parking, speed limits, passenger safety and nearby vehicles.
(d) OneShuttle waives any and all liability for delays resulting from a force majeure situation or for delays attributable to the Client. These events cannot give rise to any compensation.
(e) OneShuttle will not refund airplane tickets, or the portion of the price of said tickets that is incurred by the Client, if the latter misses his flight for a fact exclusively attributable to Client, insofar as the Client provides proof that he was unable to obtain a refund for the price of said ticket by the airline in question, or if he was not offered a replacement flight at no additional cost by said airline.
(f) If a Client’s flight or train is delayed at arrival, OneShuttle will transfer the Clients up to 24 hours after the initially scheduled time of arrival, at no additional cost. If the flight has been cancelled, the Client may request the postponement or the refund of the service, in which case OneShuttle will refund within 1 week the total amount of the reservation, and the cancellation pricing conditions stipulated in Article 9 shall not apply.
(g) The Client is required to keep to the scheduled times (if there is no special circumstance such as a flight delay or cancellation etc). In any transfer, OneShuttle’s driver will wait for up to an hour (depending on the agenda of the driver on this day) for free. After this first hour of wait, the Client could require OneShuttle’s driver to wait but he will be charged an extra 60 EUR per hour (VAT included).
(h) Onboard, the Client will act in a manner consistent with common sense and to comply with French laws and regulations in force.
(i) Any damage or deterioration of the vehicle shall be charged to the Client for the total amount of the necessary repairs.
(j) Any Client asked to leave OneShuttle’s vehicle at the driver’s request or refused boarding of OneShuttle’s vehicle will not be able to claim any refund & OneShuttle will not be liable for any additional costs incurred by the client.
8 - CLIENT’S COMPLAINS TO THE CUSTOMER SERVICE
In order to be acted upon, any complaint must reach OneShuttle within at most 2 weeks from the initially agreed contractual transfer date, by registered mail with return receipt, sent to OneShuttle.
9 - CANCELLATION & REFUND POLICY
(a) If the client is willing to cancel any transfer with OneShuttle, then:
- If the Client cancels at least 24 hours in advance, then there is no cancellation fee and 100% of the paid amount for the cancelled transfer will be refunded to the Client within 1 week.
- If the Client cancels less than 24 hours in advance but more than 2 hours in advance, then there will be a 50% cancellation fee and the Client will get back 50% of the price of the cancelled transfer.
- If the Client cancels less than 2 hours in advance, then there will be a 100% cancellation fee and the Client won’t get back anything from the amount paid for the cancelled transfer.
(b) Unused Service: if the Client does not use one or more booked service(s), this will not open any right to any refund.
(c) All cancellation requests should be sent via email to contact@1Shuttle.com and confirmed by a phone call.
10 - PROTECTION OF CLIENT’S PRIVACY AND PRIVATE DATA (CNIL)
In accordance with the Act n°78-17 of 6 January 1978 on Data Processing, Data Files and Individual Liberties and the Act of 6 August 2004 relating to the protection of individuals with regard to the processing of personal data, the Client has a right of free access to all the information concerning him in clear language and the right to ask for his data to be corrected, completed, clarified or erased.
Users of the site www.OneShuttle.com who have voluntarily provided private data may exercise free of charge their rights of access, rectification and deletion on addressing an enquiry to OneShuttle, specifying the nature of the request:

OneShuttle will do its best efforts to rectify any private data in its possession that it learns to be inaccurate or incomplete within two weeks of notification.
11 - APPLICABLE LAW & JURISDICTION
In the event of major difficulty or dispute between OneShuttle and the Client, the Parties hereby agree to seek an amicable settlement. Should this fail, any such dispute shall be submitted to the Nanterre Commercial Court. The present Terms and Conditions of Trade shall be subject to French law.
